TERMS AND CONDITIONS

In these conditions the expressions “Jerebeque Trails”, “the company”, “we”and“us”, mean Jerebeque Trails Ltd, registered in Spain with company number B05227228, Finca la Florentina S/N, 10230 Herguijuela, Cáceres.

 

The client named in the Booking form, the signatory, agrees to accept that with the payment of his/her holidays with the company accepts its terms and conditions.

1.-All activities are undertaken at the risk of the client.

 

2.-The deposit indicated, which is non-refundable, must be paid and is accepted as part payment of the total price. The balance of the cost of the holiday shall be paid no later than four weeks before departure. Should the balance not be paid by the due date, we reserve the right to treat the booking as a cancellation and levy cancellation charges.

 

3.- If a single person occupies a double/twin room they will be asked to pay extra (a single supplement). For single room supplements please refer to the price tables in the “prices” page on our website. If you wish to have a single room then the single supplement is payable locally. The payment through the payment gateway on our website does not include single supplement, the prices on our payment gateway are per person, based on twin room occupancy.

 

4.-A contract will only be constituted between the client and the company once a completed Booking Form and deposit have been received by the company and written notification of acceptance has been sent by the company to the client.

 

5.- If the client cancels his or her booking more than four weeks before departure any money paid, less the deposit, will be refunded. No money can be refunded if cancellation is made within four weeks of departure date. Cancellations must be made in writing and must be signed by the signatory to the Booking Form, and is only effective when received and acknowledged by the Company.

 

6.-The Company does not accept any liability arising from acts of non-compliance of operators or other independent organizations, their employers or agents. The Company shall have no liability for any injury, damage, loss, annoyance, anguish, disappointment, inconvenience or irregularity suffered by the customer unless, and to the extent that it has been proven to be caused by the negligence of the company. 6.- It is a condition of your booking with the company that you take out a suitable travel insurance covering you for all medical expenses, injury, death and liability as well as cancellation and curtailment, baggage and personal effects for the entire duration of your trip at the time of booking.

 

7.- The Company reserves the right without previous notice to cancel the ride for any very unusual circumstance and in such event the full sum paid by the client shall be refunded to him/her and upon tendering the same liability of the Company to the client for the said cancellation or withdrawal shall cease

 

8.- If any holiday or part thereof does not take place by force majeure (means unusual or unforeseeable circumstances beyond the control) of the company including, but without limitation, riot, civil unrest, war, terrorist activity and the threat of any of the foregoing, industrial dispute, decisions by government, natural disaster, fire, adverse weather conditions, technical or maintenance problems with transport, changes of schedule or operational decisions of air carriers and all similar events outside our control, we regret we are unable to compensate you for any losses or expenses that you may incur as a result of changes or cancellations due to force majeure, then the company shall be entitled to deduct from the refund any sums expended by them in the arrangement of the said tour or part thereof plus a reasonable sum for overhead expenses.

 

9.- The company reserves the right to modify the riding itinerary, timetable or excursions for any force majeure (subject to paragraph 8) beyond its control and the Company shall not be liable for inconvenience resulting to the client.

 

10.- All information contained in our website is published in good faith and is believed to be correct at the time of publishing. However, the provision of certain facilities may be not available at certain times or subject to weather conditions or necessary changes, etc

 

11.- Our itineraries are established and perfectly described in our web, if due to any unusual circumstance the itinerary have to be changed, the final decisions on itinerary, accommodation and conduct of the riding tours and programme will be taken by the tour leader whose decision shall be final and binding on all members of the group. Where members of groups diverge from concluded arrangements, no allowance can be claimed or will be admitted for accommodation, meals, drinks and other expenses and no refunds can be claimed.

 

12.- Bad weather conditions, damaged paths, poor surface going or routes being closed to us, may result in a trail riding holiday being changed to a local riding holiday in which case the clients will be notified as soon as possible and the difference in the cost of the holiday will be refunded in case there is that difference.

 

13.- Your specific passport and visa requirements and other immigration requirements are your responsibility and you should confirm these with the relevant consulates or embassies. We do not accept any responsibility if you cannot travel because you have not complied with any passport, visa or immigration requirements.

 

14.- Whilst riding or in the vicinity of horses in the care of the operator or guide of your trip you must comply with the instructions of that person. It is a condition of your booking that you accept that the aforementioned guide or operator is entitled to require you to dismount or to refuse to allow you to ride if for any reason, including your inability, behavior or health, they consider that you may endanger the safety or welfare of any person or the horses. If so required you have no claim and will not be entitled to any compensation or refund.

 

15.- You agree that any pictures or videos taken during a holiday arranged through us may be used in any publication or for promotional purposes, if you don´t agree you can communicate in writing before the holiday starts.

 

16.- Your booking is accepted by us on the basis of information given by you on your booking form including details of your riding ability, your weight, etc. Where these details are inaccurate, Jerebeque Trails reserves the right to change your ride itinerary or ask you not to ride and in these circumstances you will have no claim against Jerebeque Trails and will not be entitled to any refund or compensation.

 

17.- If after your booking has been confirmed you are unable to proceed with your holiday you may transfer your booking to another person, at least, 4 weeks before departure. The person has to be  introduced by you who fulfills any conditions of the holiday booked (including riding ability, weight, etc…), that person must be confirmed by us.

18.- A great deal of time, cost and effort is spent in designing the itineraries. They are essential part of the company and therefore is not allowed to publish the recording of these itineraries on any media channels (social media channels, GPS trails websites, etc…).
